01 / Who we are
Moment of Truth provides residential and commercial painting services in Brisbane, Queensland.
General enquiries: hello@momentoftruth.au. Inspection enquiries: booking@momentoftruth.au.
These terms concern the website, enquiries and inspection planning. A separate written agreement sets out the painting work, materials, price, timing and project-specific conditions. Mandatory Australian consumer and applicable Queensland building laws take priority.
02 / Using this website
You may use this site to read about services and plan a possible inspection. Provide accurate information and act with the property owner’s authority when arranging access. Do not interfere with the site, attempt unauthorised access or submit unlawful material.
Architectural imagery illustrates colours, finishes and the spaces we work with; it is not presented as a portfolio of completed MOT projects. Website information is general and must be confirmed for your property. Changes to these website terms will be dated and prospective; they do not retrospectively alter an agreed project contract.
03 / Inspections
Online booking checks available inspection times and temporarily holds a requested time for 15 minutes. A request is not a confirmed inspection and does not create a painting contract.
An inspection is confirmed when you open the private confirmation link sent to your email, press Confirm inspection and the service successfully records it. Cancellation requires opening a private cancellation link and pressing Cancel inspection. Unconfirmed holds expire automatically. We allow 90 minutes for an inspection; access or project complexity may affect that estimate.
Initial inspections are free for residential and commercial painting within our Brisbane City Council service area, subject to availability. There is no obligation to proceed with painting. To reschedule, cancel using your private email link and request a new available time. A replacement time is not guaranteed.
04 / Prices and quotes
Published ranges are indicative AUD amounts and include GST where applicable. They are not an offer to perform a particular job for that amount. Final pricing depends on size, condition, preparation, access, materials and the agreed scope.
The written quote should identify the contracting party, covered surfaces, preparation, paint system, exclusions, total price and GST treatment, validity period, expected timing and payment stages. Work begins only after the required agreement and approvals are in place.
05 / Work, access and variations
The project contract will explain access, protection of furniture and belongings, preparation requirements, work hours, colour approval, coats and clean-up. Colours on screens or digital visualisations may differ from actual paint; final selections should be checked using physical samples in the room’s lighting.
Hidden defects, moisture, extensive repairs or suspected hazardous materials may need specialist assessment outside the painting scope. Any additional work, change of price or timetable must be discussed and approved in the form required by the contract and applicable law before proceeding, subject to any lawful emergency exception.
MOT must not perform work requiring a licence unless the correct licence is held. The appropriate licence, insurance and warranty documentation should be available with the quote. This website does not certify any licence or insurance status.
06 / Payments, cancellation and statutory periods
Deposits and progress payments will be stated in the project contract and must comply with applicable law. This site does not require a 50% advance payment. Where Queensland domestic building contract deposit limits apply, the applicable statutory limit must be followed; applicability depends on the particular work and contract.
Any cancellation charge must be lawful, proportionate and clearly agreed. There is no automatic forfeiture or blanket “no refund” rule in these terms. Statutory cooling-off rights and remedies, where applicable, are preserved. The correct contract, notices, consumer guide and any required home warranty arrangements must be assessed for the actual project.
Official guidance: QBCC contracts and payments, deposits and progress payments, and cooling-off periods.
07 / Your Australian Consumer Law rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law, in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or other applicable legislation.
Where the consumer guarantees apply, services must be supplied with due care and skill, be fit for a disclosed purpose where the relevant requirements are met, and be supplied within a reasonable time when no time is agreed. Remedies depend on the nature of the failure and applicable law and may include rectification, cancellation, a refund or compensation.
Any written workmanship warranty is additional to statutory rights. Duration, coverage, exclusions, claims procedure and any mandatory warranty wording must be supplied in the actual warranty document. This website does not create an additional fixed-term warranty.
See ACCC consumer guarantees and contract and unfair terms guidance.
08 / Photos and intellectual property
Only submit material you own or are authorised to share. You retain ownership of your photographs. We use submitted photos only for project assessment and delivery. Portfolio or promotional use requires a separate agreement; the inspection form does not grant it.
Site branding, text and design may be protected by intellectual property rights. You may view and retain information for personal project planning. Other use requires permission or an applicable legal exception.
Personal information is handled as described in the privacy policy. When booking is enabled, submitted details and photos are transmitted to our booking service.
09 / Assistant and external services
The concierge uses OpenAI when enabled, with MOT service information. It directs new bookings to the inspection form and can open the cancellation email flow, but cannot directly confirm or cancel an inspection. It does not issue binding quotes, approve scope changes or give legal or technical safety advice.
Our AI assistant can make mistakes or provide incomplete information. Confirm important details, prices, scope and timing with our team and the written quotation before relying on them. The assistant cannot create a painting contract or independently confirm or cancel a booking. This notice does not exclude or limit your non-excludable consumer rights. Links to external websites are provided for convenience; their own terms and privacy practices apply. These statements do not remove rights arising from misleading representations or other applicable law.
10 / Responsibility and disputes
We aim to keep information accurate and services accessible but cannot promise uninterrupted website availability. These terms contain no blanket exclusion of liability for negligence, misleading conduct, consumer guarantees or other non-excludable obligations.
For a service complaint, email hello@momentoftruth.au and provide a description and relevant project records. We aim to acknowledge complaints promptly and work towards a fair resolution. You retain access to Queensland Office of Fair Trading, QBCC where within its jurisdiction, QCAT or the courts as appropriate.
Queensland and applicable Commonwealth law govern these website terms, without removing mandatory protections or access to competent tribunals or courts. If a provision is invalid, the remaining lawful provisions continue to operate.
